Contested Divorce

contested divorce is one in which the two parties can’t reach an agreement on one or more issues. (Contrary to popular belief, a contested divorce doesn’t take place when one party doesn’t want the divorce. In Florida, you can get a divorce without both parties agreeing to it.).

In a contested divorce, the issues you can’t resolve will go to trial, meaning they go before a judge and a judge will make a final decision.

The court will issue a final judgment on the matter, whether it’s child custody, the validity of a prenuptial agreement, or something else. After the trial, the judge will make a Final Judgment which becomes a legally binding order. That means you have to abide by what the judge rules, even if you’re not happy with it or it doesn’t work out in your favor.

If your circumstances change, you may be able to go back and petition the court to revisit its decision. However, that’s not always successful…and you’ll have to go through the entire legal process again (typically paying attorney’s fees along the way).

It's best if you and your spouses divorce attorneys reach an agreement on as many issues as possible, up front.  Doing so will help you avoid a lengthy divorce in a Florida court.


Uncontested Divorce - Do I still need an Attorney?

Possibly. We often receive calls where someone says that they want an uncontested divorce and have worked out all of their issues with their spouse before filing for divorce.  Things change drastically when the divorce papers are actually filed.  People understand that the divorce is really happening and some don't handle it well.  These situations almost always turn into a contested divorce.

How long is the divorce process?

When there are significant disagreements between you and your spouse, your divorce process could take anywhere from 6 months to 18 months. Sometimes the process takes even longer than that.

Negotiation and mediation are just a couple of the tools your divorce attorney can use in order to avoid going to court.  Mediation, if unsuccessful, will increase the length of time you spend getting divorced.
